2. Scope of Application
These Terms and Conditions of Sale apply to all orders placed on the Atmo Sportswear website.
By placing an order on the website, the customer confirms that they have read, understood and accepted these Terms and Conditions of Sale.
These Terms apply to purchases made by consumers for personal use. They do not apply to purchases made for resale or professional distribution purposes.
3. Products
Atmo Sportswear curates and sells products from independent running and outdoor brands.
The essential characteristics of each product are presented on the relevant product page, including, where available, descriptions, images, sizes, colours, materials, technical features and shipping information.
Product images are provided for illustrative purposes. Slight differences may exist between the images shown on the website and the product received, particularly due to screen settings, lighting or brand imagery.
Atmo Sportswear makes every effort to ensure that product information is accurate and up to date. However, minor errors or omissions may occur.
4. Availability
Products are offered subject to availability.
If a product becomes unavailable after an order has been placed, Atmo Sportswear will contact the customer as soon as possible and may offer:

a replacement product;

a delayed shipment;
-
a partial or full refund.
If no suitable solution is found, the unavailable product will be refunded.
5. Prices
Prices are displayed in euros.
For deliveries within France and eligible European countries, the price paid at checkout includes the applicable VAT and the shipping fees shown at checkout.
Shipping fees are displayed before the order is confirmed.
Atmo Sportswear reserves the right to change prices at any time. The price applicable to an order is the price displayed at the time the order is placed.
6. Orders
To place an order, the customer must select one or more products, add them to the cart, provide the required delivery and billing information, select the available shipping method, and complete payment.
Before confirming the order, the customer is responsible for checking the accuracy of the order details, including products, sizes, quantities, delivery address and contact information.
Once the order has been placed, the customer will receive an order confirmation by email.
Atmo Sportswear reserves the right to refuse or cancel an order in case of:

obvious pricing or product information error;

suspected fraud;

payment issue;
-
product unavailability;
-
abnormal or abusive order behaviour.
7. Payment
Payment is due at the time the order is placed.
Accepted payment methods are displayed at checkout.
Orders are processed only once payment has been successfully confirmed.
Refunds, where applicable, are issued using the original payment method, unless otherwise agreed.
8. Shipping and Delivery
Atmo Sportswear currently ships to France and most countries within the European Union.
Products may be shipped directly by the independent brand fulfilling the order.
Shipping times and costs may vary depending on:

the brand fulfilling the order;

the shipping method selected;
-
the destination country.
For deliveries within France, shipping fees are currently capped at €9.90.
For deliveries to other eligible European countries, shipping fees are currently capped at €19.90.
For deliveries within France, shipping is free for orders over €250.
The exact shipping fees are displayed at checkout before the order is confirmed.
The customer is responsible for providing a complete and accurate delivery address. Atmo Sportswear cannot be held responsible for delivery issues caused by incorrect or incomplete information provided by the customer.
9. Multi-Brand Orders
Atmo Sportswear curates products from independent brands.
As a result, orders containing products from different brands may:

be shipped separately;
-
arrive in several parcels;
-
have different shipping times;
-
require returns to different locations.
Shipping costs may be calculated separately for each brand, but remain subject to the shipping caps stated above where applicable.
Specific return instructions will be provided once a return request is initiated.
Customers should not send products back before receiving the relevant return instructions from Atmo Sportswear.
10. Customs Duties, VAT and Import Fees
For deliveries within France and eligible European countries, the price paid at checkout includes the applicable VAT and the shipping fees shown at checkout.
The customer will not have to pay any additional customs duties, VAT, or import fees upon delivery.
When a product is shipped from outside the European Union, Atmo Sportswear and/or the brand handle the required import process whenever applicable, so that the total cost remains clear before the order is placed.
11. Right of Withdrawal
In accordance with European Union regulations, the customer has the right to withdraw from their purchase within 14 days of receiving the order, without providing any reason.
To exercise this right, the customer must contact Atmo Sportswear at support@atmo-sportswear.com within this period.
The customer must then return the relevant item in accordance with the instructions provided by Atmo Sportswear.
Returned items must:

be unused and unworn;
-
be in their original condition;
-
be returned with their original packaging and tags, when applicable.
12. Exceptions to the Right of Withdrawal
Returns are not applicable for customized or made-to-order products.
The right of withdrawal may also be excluded for products that cannot be returned for hygiene or health protection reasons once unsealed, where applicable under consumer law.
Any applicable exception will be indicated where relevant.
13. Return Shipping Costs
Return shipping costs are the responsibility of the customer, unless the product is defective or the wrong item was received.
If the order originally qualified for free shipping and the customer returns one or more items, a €9.90 shipping fee will be deducted from the refund.
This fee corresponds to the initial shipping cost covered by Atmo Sportswear.
This deduction does not apply if the return is due to a defective product or an incorrect item.
14. Refunds
Once the returned item is received, or once valid proof of return is provided, refunds are processed within 14 days.
Refunds are issued using the original payment method.
If the return concerns a defective product or an incorrect item, the original standard shipping costs will also be refunded.
If a €9.90 shipping fee applies because the order originally benefited from free shipping, this amount will be deducted from the refunded amount.
Atmo Sportswear may withhold the refund until the returned item is received or until the customer provides valid proof of return.
15. Defective, Damaged, Incorrect or Non-Conforming Products
All products sold on Atmo Sportswear are covered by the applicable legal guarantees, including the legal guarantee of conformity.
If the customer receives a defective, damaged, incorrect or non-conforming product, they should contact support@atmo-sportswear.com, including:

the order number;
-
photos clearly showing the issue;
-
a short description of the problem.
Depending on the situation and in accordance with applicable law, Atmo Sportswear may offer:

repair;
-
replacement;
-
refund.
In this case, return shipping costs will not be charged to the customer.
16. Legal Guarantees
Customers benefit from the legal guarantees provided by applicable French and European consumer law.
These guarantees apply independently of any commercial warranty that may be offered by a brand.
Nothing in these Terms and Conditions limits or excludes the customer’s statutory consumer rights.
17. Customer Obligations
The customer agrees to provide accurate, complete and up-to-date information when placing an order.
The customer is responsible for ensuring that the products ordered are suitable for their intended use, including size, fit, activity type and technical requirements.
The customer must use the products in accordance with their intended purpose and any instructions or recommendations provided by the brand.
18. Liability
Atmo Sportswear is responsible for the proper performance of its obligations under applicable consumer law.
However, Atmo Sportswear shall not be held liable for damages resulting from:

improper use of a product;

normal wear and tear;
-
failure to follow care instructions;
-
inaccurate information provided by the customer;
-
events outside Atmo Sportswear’s reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
19. Personal Data
Personal data collected through the website is processed in accordance with Atmo Sportswear’s Privacy Policy.
Personal data may be used to process orders, manage payments, arrange delivery, handle returns, provide customer support and comply with legal obligations.

20. Intellectual Property

22. Consumer Mediation
In the event of a dispute, the customer should first contact Atmo Sportswear in order to seek an amicable solution.
If no amicable solution is found, the customer may have the right to refer the matter to a consumer mediator, in accordance with applicable French consumer law.
The details of the competent consumer mediator will be made available to the customer where required.
23. Governing Law
These Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the customer retains the benefit of any mandatory consumer protection rules applicable in their country of residence.
24. Updates to These Terms
Atmo Sportswear may update these Terms and Conditions of Sale from time to time.
The version applicable to an order is the version available on the website at the time the order is placed.
